TERMS AND CONDITIONS OF SALE Effective Date: Oct 14, 2026 These Terms and Conditions (“Terms”) govern purchases made through Taino Tactical (“Taino Tactical,” “Seller,” “we,” “us,” or “our”). By placing an order through our website, the purchaser (“Purchaser,” “you,” or “your”) acknowledges these Terms and agrees to comply with the applicable provisions. These Terms apply to purchases of body armor, ballistic-resistant plates, tactical equipment, and other products sold through our online store, unless a separate written agreement applies. 1. CUSTOMER ELIGIBILITY Purchasers must be at least 18 years old and must satisfy any higher minimum-age requirement imposed by applicable law. Purchasers must be legally eligible to purchase, receive, own, possess, and use the products ordered. Purchasers may not place an order when prohibited from doing so by applicable federal, state, territorial, or local law. Purchasers are responsible for providing accurate information during checkout and responding truthfully to reasonable requests for information needed to verify an order's legality. Taino Tactical reserves the right to decline, suspend, or cancel an order when reasonably necessary to address legal restrictions, eligibility concerns, suspected fraud, or compliance obligations, subject to applicable law. 2. COMPLIANCE WITH APPLICABLE LAWS Purchasers are responsible for understanding and complying with all laws applicable to their purchase, possession, transportation, transfer, and use of the products purchased. Federal law restricts the purchase, ownership, or possession of body armor by certain individuals convicted of qualifying violent felonies, subject to applicable statutory provisions and defenses. Purchasers must not place an order if their purchase or possession would violate applicable law. Taino Tactical does not authorize or encourage unlawful purchases, possession, transfers, resale, distribution, export, or use of any product. Purchasers must not use another person, intermediary, or business to evade legal restrictions or conceal the identity of the actual purchaser or intended recipient. Purchasers are responsible for obtaining any permits, authorizations, or other documentation legally required of them. Nothing in these Terms relieves Taino Tactical of its own legal obligations as a seller. 3. RESTRICTED DESTINATIONS AND TRANSACTIONS Taino Tactical may restrict or refuse sales to jurisdictions, persons, or entities when required by law or when reasonably necessary to comply with applicable legal requirements. We will not accept orders for body armor requiring sale or delivery into New York or Connecticut. Purchasers must provide accurate billing, shipping, and eligibility information. We reserve the right to request additional documentation, decline an order, or issue a refund when a transaction cannot lawfully be completed. Orders to Puerto Rico and other U.S. jurisdictions are subject to the applicable laws and shipping restrictions governing the specific transaction. International orders and exports are not available unless expressly authorized by Taino Tactical and permitted by all applicable laws, regulations, and export-control requirements. 4. PRODUCT DESCRIPTIONS AND PROTECTIVE CAPABILITIES We make reasonable efforts to provide accurate product descriptions, photographs, specifications, dimensions, materials, protection ratings, and other relevant information. Product specifications and claims are based on available manufacturer documentation and other information reasonably relied upon by Taino Tactical. Product-specific claims should be reviewed before purchase. Descriptions such as “tested,” “ballistic resistant,” “NIJ compliant,” or “NIJ certified” are not interchangeable. We will not represent a product as certified or compliant with a particular standard unless the representation is supported by appropriate documentation for the specific model. Photographs and illustrations are provided to help customers understand the products offered. Minor variations in appearance, color, packaging, or presentation may occur, provided that the product supplied materially conforms to its description and applicable legal requirements. No product description, photograph, advertisement, or general statement should be interpreted as a guarantee that a product will prevent injury or death under all circumstances. 5. BODY ARMOR WARNINGS AND LIMITATIONS Body armor and ballistic-resistant plates provide limited protection under specified conditions. They are not bulletproof and cannot guarantee protection against every projectile, ammunition type, impact condition, or other threat. Actual performance may depend on the specific model, tested threat, impact location, angle of impact, distance, condition of the product, environmental exposure, fit, coverage area, and compliance with manufacturer instructions. Body armor may fail to prevent penetration, blunt-force trauma, serious injury, or death. Protection is limited to the areas covered by the armor and does not eliminate risks to uncovered body parts or other areas. Purchasers must review all applicable product specifications, warnings, manufacturer instructions, maintenance requirements, inspection guidance, and service-life limitations before use. Products must not be used when damaged, compromised, improperly modified, or otherwise deemed unsafe under applicable manufacturer instructions. Where armor is intended to be used in conjunction with other protective equipment, purchasers must verify compatibility and follow the applicable instructions. Purchasers acknowledge the inherent limitations of protective equipment and the risks associated with exposure to ballistic threats. This acknowledgment does not waive any right or remedy that cannot lawfully be waived. 6. PRICING, PAYMENT, AND ORDER ACCEPTANCE All prices, product availability, shipping charges, and applicable taxes will be disclosed as required by law. Submitting an order constitutes an offer to purchase. An order confirmation acknowledging receipt does not necessarily constitute final acceptance of the order. Taino Tactical may decline or cancel an order for legitimate reasons, including product unavailability, pricing or listing errors, suspected fraud, payment authorization failure, or legal restrictions. Where payment has been collected for an order that is canceled, any required refund will be processed in accordance with applicable law. Nothing in this section permits us to disregard an accepted order or a customer's rights where doing so would violate applicable law. 7. SHIPPING AND DELIVERY Shipping estimates are provided for informational purposes unless an express delivery commitment is made. Delivery dates may be affected by carrier operations, weather, disruptions, incorrect addresses, or other circumstances beyond our reasonable control. Purchasers are responsible for providing a complete and accurate shipping address and ensuring that the products ordered may lawfully be delivered to that destination. If a shipment arrives visibly damaged, the Purchaser must document the packaging and product condition and contact Taino Tactical as soon as reasonably possible, within 48 hours of delivery. Prompt reporting helps us investigate carrier claims and arrange appropriate assistance. Failure to report a problem within 48 hours will limit shipping damage claims. Responsibility for loss, damage, delivery, and risk of loss will be determined in accordance with the applicable transaction terms and governing law. 8. RETURNS, REFUNDS, AND EXCHANGES Because body armor is safety-related equipment, all body armor sales are final. Unless otherwise stated in a product-specific policy or required by applicable law, we do not accept returns or exchanges solely because a Purchaser changes their mind, selects the wrong size, or no longer wants the product. Purchasers are encouraged to review product dimensions, fitment information, specifications, and compatibility before completing a purchase. Purchasers must contact Taino Tactical for return authorization and instructions before sending a product back. Products must not be returned without appropriate authorization, except where applicable law provides otherwise. Any refund, replacement, repair, or other remedy will be handled in accordance with the applicable product warranty, our published policies, and applicable law. 9. WARRANTIES Any manufacturer's warranty applicable to a product will be governed by the manufacturer's published warranty terms. Taino Tactical does not independently extend a manufacturer's warranty unless expressly stated in writing. Nothing in these Terms is intended to disclaim an express warranty created by an applicable product description, written promise, or other representation where such disclaimer would be legally ineffective. Any exclusion or limitation of implied warranties will apply only to the extent permitted by applicable law and only when the requirements for an effective exclusion or limitation have been satisfied. To the extent legally permitted, any applicable disclaimer of implied warranties, including merchantability or fitness for a particular purpose, must be presented conspicuously and in accordance with applicable law. No warranty disclaimer in these Terms excludes a warranty or remedy that cannot lawfully be excluded. 10. PRODUCT CARE, MISUSE, AND MODIFICATION Purchasers must use, store, inspect, maintain, and care for products in accordance with the applicable manufacturer's instructions. Unauthorized modifications, improper storage, exposure to damaging conditions, misuse, or use contrary to manufacturer instructions may compromise product performance and may affect applicable warranty coverage. Purchasers should discontinue use of products that show damage or other signs of compromised protective capability and follow manufacturer guidance regarding inspection, replacement, or disposal. Nothing in this section relieves Taino Tactical of liability that applicable law does not permit us to exclude. 11. LIMITATION OF LIABILITY To the fullest extent permitted by applicable law, Taino Tactical will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from a transaction or product use where such exclusions are legally enforceable. This limitation does not exclude or restrict liability for fraud, willful misconduct, or other conduct for which liability cannot legally be limited. It also does not exclude liability for defective products or personal injury to the extent such liability cannot lawfully be excluded. Nothing in these Terms limits a Purchaser's nonwaivable statutory rights or remedies. Any legally permissible limitation will be interpreted narrowly and applied only to the extent allowed by the law governing the particular transaction. 12. INDEMNIFICATION To the extent permitted by applicable law, Purchasers agree to be responsible for third-party claims, losses, or expenses to the extent caused by their unlawful conduct, fraud, or material breach of these Terms. This provision does not require a Purchaser to indemnify Taino Tactical for our own negligence, misconduct, legal violations, or other conduct to the extent that such indemnification is prohibited by law. Any indemnification obligation is subject to applicable law and the facts of the particular claim. 13. LEGAL REQUESTS AND INVESTIGATIONS Taino Tactical will respond to valid legal process and cooperate with government authorities as required by applicable law. We may preserve or disclose relevant information when legally required or when otherwise authorized by law. Any disclosure of customer information will be subject to applicable privacy laws and our published Privacy Policy. Nothing in this section authorizes disclosure beyond what is legally permitted or required. 14. PRIVACY AND CUSTOMER INFORMATION Customer information is handled in accordance with our Privacy Policy, which describes the information we collect, how we use it, and any applicable disclosures or retention practices. Purchasers should review the Privacy Policy before completing an order. 15. GOVERNING LAW AND DISPUTES These Terms will be governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise. Any dispute concerning these Terms will be handled in a court or other forum with appropriate jurisdiction, subject to applicable venue requirements and any nonwaivable rights of the Purchaser. Nothing in this section prevents a Purchaser from exercising a right that applicable law requires to remain available. 16. CHANGES TO THESE TERMS Taíno Tactical may revise these Terms from time to time. Updated Terms will be posted on our website with a revised effective date. Unless otherwise required or permitted by law, changes will apply prospectively and will not retroactively alter the terms governing a completed purchase. Purchasers should review the Terms applicable to their transaction before placing an order. 17. SEVERABILITY If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Any invalid or unenforceable provision will be interpreted or limited only as necessary to comply with applicable law. 18. ENTIRE AGREEMENT These Terms, together with any applicable product-specific terms, published policies, and written warranty documents, constitute the agreement governing the relevant purchase, subject to any separate written agreement and applicable law. Nothing in these Terms excludes legally binding representations or rights that cannot lawfully be excluded. 19. PRODUCT ORIGIN AND MILITARY AFFILIATION Unless expressly stated in the relevant product description, products sold by Taino Tactical are not represented as military-issued equipment, military-approved equipment, or officially endorsed by any military branch or government agency. Any military origin, certification, approval, or affiliation claim will be made only where accurate and appropriately substantiated. 20.
